In August 2012, following the German Cologne district court ruling that non-therapeutic circumcision constitutes criminal bodily assault, Austria's Justice Ministry issued a clarification that doctors could legally perform infant circumcisions without criminal risk β a ministerial legal opinion, not legislation. No Austria-specific court ruling on circumcision has been identified. Germany responded with Β§1631d BGB (December 2012) expressly legalising the practice; Austria took no equivalent legislative step.
